We recently launched this year’s edition of our Dentons’ Pick of Canadian Regulatory Trends to Watch. In this annual series, Dentons’ team of leading regulatory lawyers provide their perspective on the trends that will define 2023, including in the areas of energy, climate change and the environment, telecommunications, health, foreign investment review, trade, ESG (environmental, social and governance) disclosure, consumer products and administrative law.

International trade trends to watch in 2023: Increased influence of geoeconomics and ESG

The international trade landscape in 2023 will continue to be shaped by geopolitics and ESG considerations. We outline some of the key Canadian international trade trends and developments that we believe will persist throughout 2023.

Consumer products trends to watch in 2023: Increased regulation of plastic packaging for all producers including online marketplaces

In 2022, the broader implications of the designation of “plastic manufactured items” as a toxic substance under the Canada Environmental Protection Act (CEPA) began to emerge. In 2021, the first tranche of regulations effectively banned six categories of single use plastics (SUPs) from the Canadian market.

Foreign investment trends to watch in 2023: Canada to batten down national security hatches

For 2023, the Canadian Government will continue battening down the hatches under the Investment Canada Act (ICA) to address national security threats arising from foreign investments. This renewed vigour in enforcement may, at least partially, reflect a response by the Government to criticism for not conducting a formal national security review in respect of the early 2022 acquisition by a Chinese state-owned enterprise (SOE) of a Canadian mining company with lithium assets in South America.
