Court clarifies required cannabis retail store setback from schools

On October 9, 2020, the Ontario Superior Court released its decision, Sticky Nuggz Inc. v Alcohol and Gaming Commission of Ontario, which is one of the first cases to consider a decision made by the Alcohol and Gaming Commission of Ontario (AGCO) in respect of Ontario’s retail cannabis regime. At the heart of the case was the correct methodology for measuring the distance of a proposed cannabis retail store location from a school and whether such distance ought to be measured on a “straight-line” or an “on the street” basis.
