In January, we launched this year’s edition of our Dentons’ Pick of Canadian Regulatory Trends to Watch. In this annual series, Dentons’ team of leading regulatory lawyers provide their perspective on the trends that will define 2023, including in the areas of energy, climate change and the environment, telecommunications, health, foreign investment review, trade, ESG (environmental, social and governance) disclosure, consumer products and administrative law.

Regulatory litigation trends to watch in 2023: Uncertainty in judicial review of regulations

There is currently a schism in Canadian regulatory law regarding how easy it should be for businesses to challenge government regulations in court. Recent decisions by the Federal Court of Appeal and the Alberta Court of Appeal have taken opposing views on this issue and courts in other provinces, such as Ontario and British Columbia, are likely to weigh in during the course of 2023.

ESG trends to watch in 2023: ESG liability for Canadian companies, directors and officers

Environmental, social and governance (ESG) concerns have been increasingly on the radar of Canadian companies in the past few years, garnering significant attention and discourse. With increased regulatory enforcement and a growing concern and activism relating to environmental issues, litigation risk is increasing for Canadian companies and their directors and officers.
